London councils confirm bids for office to residential exemption

The new permitted development rights were announced by the Department for Communities and Local Government (DCLG) last week. The DCLG confirmed that there would be an opportunity for local authorities to seek an exemption from the right if they can demonstrate that the right would create "substantial adverse economic consequences".

The Royal Borough of Kensington and Chelsea said in a statement that it would make a "strong case" to Government for an exemption and that ministers are already aware of the Council's "serious concerns".

"We have distinct circumstances in Kensington and Chelsea with vast differences between office and residential property values. The Council will strongly defend small and medium-sized businesses staying in the area," the Council said.

The City of London Corporation has long been opposed to the plans, saying that the creation of such rights would undermine London as the world's leading financial centre.

"The City of London has made no secret of our concern about the impact of the proposed change to planning rules upon our role as a world business centre," said the Corporation's city planning officer Peter Rees previously in a statement.?

"Property consultants estimate that 20% of the office floor space in the Square Mile would be in immediate danger of conversion to flats if we do not achieve an exemption from the rule change," Rees said.

The Corporation has now confirmed it will make a bid to seek exemption from the new rights, according to a report in Planning Magazine.

Dinner's on George Clooney in Germany!

Dinner's on George Clooney! One group of diners at the Grill Royal restaurant in Berlin?were treated to a free meal because the actor was worried that he and his friends at a nearby table were making too much noise, Clooney's representative has confirmed to TODAY.

According to English-language publication The Local, German newspaper Bild reported that Clooney and Co. weren't disturbing the others in any way.

"They had behaved in a very cultivated manner," one man in the group told the paper, "I was stunned."

According to The Local, the man never recognized Clooney, even when he stopped by the star's table to leave a business card in hopes he could repay the gesture some day.

The newspaper reported that the dinner bill was around 100 Euros, or $135 U.S.

It's far from Clooney's first generous gesture. Back in October, paparazzi captured a photo of the actor giving money to a man sitting on a New York street wearing military dog tags.

Clooney is in Germany to direct and star in "Monuments Men," an upcoming big-screen drama also starring Daniel Craig and Cate Blanchett. Based on Robert M. Edsel's book, the film is about a group of Allied art experts racing to save priceless artworks from destruction by the Nazis.

Matt Lubick, the wide receivers coach and recruiting coordinator for the Duke Blue Devils, has left the program to take the position of passing game coordinator and wide receivers coach at the University of Oregon, leaving Duke without their top recruiter just days before National Signing Day.

Lubick made a significant contribution in both of his roles, as Duke was the only team in the nation to have three different players with sixty or more catches (Crowder ? 76, Vernon ? 85, Scott ? 66) and was just the second team in ACC history to have two receivers post 1,000 yards in a single season (Crowder & Vernon ? 1,074). As a result of the unit?s success, Lubick was awarded with the 2012 Wide Receiver Coach of the Year award by FootballScoop.

Where he?ll be missed most, however, is in the recruiting game. Lubick?s recruiting had Duke in contention for a few of the nation?s premiere recruits, which was above and beyond where they were before Lubick. Obviously, you can argue that the increase in performance in recruiting is due to the overall increase in performance and direction of the team under Cutcliffe, but Lubick was also responsible for extending Duke?s reach in recruiting, as he took on the duties of recruiting players on the other side of the nation, landing numerous athletes from western states.

This news and his recruiting success shouldn?t come as a surprise, as Lubick has numerous ties to the west coast and the understanding is that he would like to be a head coach one day. This is a tough blow for a Blue Devils team that was just starting to make an impact in the recruiting game, and the loss is already affecting them.

Pentagon to boost cybersecurity force

WASHINGTON (Reuters) - The Pentagon plans to assign significantly more personnel in coming years to counter increasing threats against U.S. government computer networks and conduct offensive operations against foreign foes, a U.S. defense official said on Sunday.

The plan, which would increase both military and civilian staffing at U.S. Cyber Command, comes as the Pentagon moves toward elevating the new command and putting it on the same level as the major combatant commands.

The official said no formal decisions had been made on the expanding staffing levels or changing Cyber Command into a "unified" command like U.S. Strategic Command, which currently oversees cyber command and the U.S. nuclear weapons arsenal.

Any changes to the combatant command structure would be made based on strategic and operational needs, and take into account the need for efficient use of taxpayer dollars, said the official, who was not authorized to speak publicly.

The Pentagon was working closely with U.S. Cyber Command and the major military commands to develop "the optimum force structure for successfully operating in cyberspace," the official said.

The Washington Post, quoting senior defense officials, reported late Sunday that the Pentagon had decided to expand Cyber Command's current staffing level of 900 to 4,900 in coming years.

The official confirmed that Cyber Command planned to expand its force significantly, but said the specific numbers cited by the Post were "pre-decisional."

The newspaper said senior Pentagon officials had agreed to increase the force late last year amid a string of attacks, including one that wiped out more than 30,000 computers at a Saudi Arabian state oil company. it said

The plan calls for creating three types of force under the Cyber Command, said the defense official.

"National mission forces," would protect computer systems that undergird electrical grids and other kinds of infrastructure. "Combat mission forces," would help commanders abroad execute attacks or other offensive operations, while "cyber protection forces," would focus on protecting the Defense Department's own systems.

Details were still being worked out, the official said.

Who's silencing Guantanamo court audio feed, judge asks

GUANTANAMO BAY U.S. NAVAL BASE, Cuba (Reuters) - The sound was abruptly cut in the Guantanamo war crimes court on Monday, prompting the angry judge to question whether someone outside the room was censoring pretrial hearings for five men accused of plotting the September 11 attacks on the United States in 2001.

In all hearings for the alleged al Qaeda operatives who were previously held in secret CIA prisons, a court security officer seated near the judge controls a button that muffles the audio feed to spectators when secret information is disclosed. A red light flashes and observers hear nothing but static.

The feed was cut when David Nevin, a lawyer for the alleged mastermind of the hijacked plane plot, Khalid Sheikh Mohammed, asked if the lawyers and judges needed to meet in closed session before considering a defense request.

When the feed was restored moments later, the judge, Army Colonel James Pohl, indicated it wasn't the court security officer who cut the sound in the proceedings formally known as military commissions.

"If some external body is turning things off, if someone is turning the commissions off under their own views of what things ought to be, with no reason or explanation, then we are going to have a little meeting about who turns that light on or off," Pohl said tersely.

He seemed to be addressing the prosecution team and told them that Nevin had merely referred to the caption of an unclassified document - one asking the judge to order that the secret CIA prisons where the defendants say they were tortured be preserved as evidence.

A short time later, the judge said he would meet in closed session with the lawyers and reopen the public part of the hearing on Tuesday. The episode enlivened the first day of a weeklong pretrial hearing in the military tribunal at the Guantanamo Bay U.S. Naval Base in Cuba.

Mohammed and his four co-defendants are accused of training and aiding the hijackers who slammed commercial jetliners into the World Trade Center in New York, the Pentagon and a Pennsylvania field on September 11, 2001. They could be executed if convicted of charges that include terrorism, attacking civilians and murdering 2,976 people.

Under a program during the presidency of George W. Bush, the defendants were among the suspected al Qaeda captives who were moved across borders without judicial review and held and interrogated in secret CIA prisons overseas.

The CIA has acknowledged that Mohammed was subjected to the simulated drowning technique known as waterboarding. The defendants said they also were subjected to sleep deprivation, threats, and being chained in painful positions.

The defense lawyers argue that constituted illegal pretrial punishment and "outrageous government misconduct" that could justify dismissal of the charges, or at least spare the defendants from execution if convicted.

'CRIME SCENE'

Pohl ordered in 2004 that the Abu Ghraib prison in Iraq be preserved as a "crime scene." He was at the time presiding over the trial of U.S. military police officers accused of torturing and photographing prisoners at Abu Ghraib.

It was unclear whether Pohl had authority to order the preservation of the CIA prisons, if they still exist. The government has kept secret their location, arguing that disclosure could threaten U.S. national security and put allies at risk.

Polish prosecutors are investigating allegations that one of the sites was in Poland, and there is evidence that the CIA set up others in Romania, Lithuania and Thailand, according to reports by the Council of Europe and the United Nations.

The chief prosecutor, Brigadier General Mark Martins, said he does not plan to introduce evidence obtained from the defendants or anyone else via torture, cruelty or inhuman treatment - which is prohibited by U.S. law and international treaty.

In a departure from the Bush administration, the Obama administration has made clear that any interrogation techniques must adhere to those long established in the Army Field Manual, which prohibits torture.

The defendants have been in U.S. custody for a decade, but there are still many legal and evidentiary issues that must be resolved before their trial begins.

Three of them wore camouflage jackets and accessories over their white tunics in court on Monday. As in earlier hearings, they alternated between refusing to answer the judge and critiquing the United States and the court. All five said they understood their legal rights could be compromised if the judge granted their request to skip some court sessions.

"We don't have any motivating factors that would invite us to come to court," said Yemeni defendant Walid bin Attash, who said restrictions at Guantanamo had thwarted efforts to build trust with defense lawyers.

Nine Financial Resolutions For 2013 - Bad Credit Auto Loans

Less than a month into the New Year we offer up some tips from the Illinois CPA Society to strengthen your finances that also apply to consumers with poor credit

At Auto Credit Express we?ve spent the past twenty years helping car buyers with credit problems find those new car dealers that can give them their best opportunities for approved auto loans. But we?re also not above passing on someone else?s good ideas when it comes to credit repair and managing finances, especially when they?re timely as well as particularly good. Point in fact: we came across an article by the Illinois CPA Society a few years ago and we?ve decided to share portions of it again.

Here are some excerpts from it:

Your Financial Fitness

The Illinois CPA Society recommends these nine resolutions to bolster your financial standing and keep it healthy.

1. Slim down your spending

Keep track of the amount of money you spend and take time to think about why you spend the amounts that you spend. Do you spend more when stressed, tired or hungry? Learn to avoid situations which might lead to overspending, and always think twice before buying. It?s not just how much you make but how much you spend that most influences your finances.

2. Be Honest

When estimating monthly expenses, consider typical monthly spending amounts. If you normally spend $300 on groceries, don?t write down ?$200? in your grocery category. Write down ?$300? and then aim for $200. Underestimating will get you in trouble.

3. Stick to a budget

Maintaining a budget and careful tracking of your spending are the only effective ways to keep tabs on your cash flow. Once you see where your money is going, you can make better choices on how best to spend less and save more. Resist the urge to abandon your budget, especially in the face of negative comments from friends and family.

4. Work off debt

Eliminating your debt can seem like an overwhelming task, especially if you?ve been shackled with it for some time. However, like all tasks, it starts with an action plan and small steps. First, you should outline a very specific strategy for accomplishing this goal. It needs to consist of more than ?I am going to spend less.? Second, consider using a credit counseling service or setting personal limits for your credit cards each month. Paying off your debt may end up taking more than a year or two, but having a clear action plan and asking yourself each day what you can do to reduce your dependence on credit cards will go a long way in making your 2009 finances more healthy.

5. Flex your money knowledge

Financial planning is a major step towards achieving financial security. It can help you become better prepared for whatever life throws at you. Make yourself aware of basic issues such as your net worth, when your debts need to be paid off, your retirement goals, and your capital needs to buy house/car/appliances. Get smart about your money and teach your children how to use it and save it.

6. Set Goals and Priorities

You will never hit the target if you don?t know what your goal is. Identify and prioritize your financial goals and when you would like to achieve them by. For instance, do you know when you want to buy a house and its cost, what it will cost you for your child?s education 20 years from now, or your retirement expenses 10 years from now?

7. Exercise caution and emphasize safety

Focus on creating a financial safety net; save for emergencies. Generally, you should have an emergency fund to cover six months worth of living expenses in the event you lose your job or suffer a serious illness.

8. Keep your records in shape

Keeping financial records in order can save you time, money and trouble in the event of an emergency. Have photos and videos of everything you own and keep them in a safe place. Store permanent records such as birth certificates, property deeds, insurance policies, wills, power of attorney and other important documents in a safe, fireproof location. Make sure your spouse, family and executor know where these documents are stored. Copies of these documents and other financial records should be kept in a clearly marked filing system in your home.

9. Get a Finance Coach

January is an ideal time to meet and develop a financial plan with your CPA advisor. Outline some short and long term goals together.

It?s hard not to agree with the Illinois CPA Society that the New Year is a good time to take the following advice: step back and assess your financial situation for the coming year and resolve to make it as good as you can.

We have a very good Spam filter, but still every now and then a phishing email will slip through.? My business email is easy to find so I get? a wide assortment of unsolicited emails. This week I received a deviation on an scam that has been around for years ? your package was returned and click this link to get it.? I also received one that my LogMein SSL Certificate had been suspended?- click here to fix.?Of course, the links are malicious and at least, would come with some irritating pop-ups and at worse, steal your identity, seize your system and ruin your computer.

These exploits are designed to cause an immediate emotional response that will make you click before your think.? Because if you look closer, the fraud is apparent.? The?mail and parcel carriers do not typically?use email for package routing information?although some will let you elect mobile or email notification.? The body of the emails usually have?spelling or grammatical errors and often the links take you to strange sites. A?suspended LogMein SSL Certificate is a problem, but too suspicious to believe the email.

If you think the issue may be real, do some additional research but don?t click any links. Even with legitimate emails, your clicks are tracked by?embedded links.? So if you don?t want to be tracked or scammed, avoid links.

You already know these tips for protecting yourself, but let?s review:

1. Have a good Spam Filter.? Still about 90% of the emails sent worldwide are Spam and many are malicious. A good filter will catch most Spam.

2. Use virus protection.? Even if you use a great Spam Filter, you still need virus protection for those threats that slip through. We like Symantec for our business users.

3. Use malware protection. There are several that you can try and use free for home use. We like MalwareBytes and Advanced System Care. The licensed versions provide real-time protection.

4. Do not open files or click links in emails unless you trust and know the source.??And even if you know and trust the source be sure it is a?real email from them. Email accounts can be hacked and?malicious emails sent from?your friend?s account.

5.? If you think you are infected, consult an expert.? If it looks really bad, disconnect your computer from the network or Internet. If it looks really, really bad, turn off your computer until help is available.

6. Don?t put your credit card information in those pop-ups that guarantee to remove the infection, they are scams.

7.?Don?t forward email unless absolutely necessary.? This is not only for security but for proper etiquette as well.? If you have to forward something be sure it is not a hoax and that the recipient wants to receive. If you have to send that funny joke, be sure to have the recipient?s permission.

We look at online threats constantly, but sometimes there is one so good that even the experts are initially fooled.

(AP) ? The hacker-activist group Anonymous says it hijacked the website of the U.S. Sentencing Commission to avenge the death of Aaron Swartz, an Internet activist who committed suicide.

The website of the commission, an independent agency of the judicial branch, was taken over early Saturday and replaced with a message warning that when Swartz killed himself two weeks ago "a line was crossed."

The hackers say they've infiltrated several government computer systems and copied secret information that they now threaten to make public.

Family and friends of Swartz, who helped create Reddit and RSS, say he killed himself after he was hounded by federal prosecutors. Officials say he helped post millions of court documents for free online and that he illegally downloaded millions of academic articles from an online clearinghouse.

Interoperability holds the key to EHR, mobile health success ...

Neil_Versel_LargeHave you seen all the pushback of late against the direction of the ?meaningful use? EHR incentive program and EHRs in general?

The year started with the publication of a RAND Corp. study in Health Affairs cautioning that health IT had fallen far short of its potential so far. Notably, EHR design and implementation problems, a lack of interoperability and continued reluctance among providers to redesign care processes and spend time trying to ?master difficult-to-use technology? has stood in the way of expected cost savings, efficiency gains and better care.

Meanwhile, interest groups all over the country have been publicizing their comments to the Department of Health and Human Services in response to the Health IT Policy Committee?s preliminary recommendations for Stage 3 of meaningful use, and quite a few have been critical of the whole direction of the program.

Not surprisingly, the American Medical Association (AMA) and the American Hospital Association (AHA) both said it was premature to develop rules for Stage 3 before Stage 2 starts in 2014 and while many providers have not yet achieved Stage 1. But even some EHR vendors have expressed reservations.

?The pace is too damn high,? John Glaser, Siemens Healthcare?s CEO of health services, told Forbes, suggesting that there hasn?t been enough time to focus on interoperability of health information. ?We need the time to do it right,? Glaser said.

I don?t think anyone would argue at this point that there aren?t gaps in meaningful use and in health IT, particularly when it comes to interoperability. And that?s where mobile and personal health devices need to come in.

Last week, the Association for Advancement of Medical Instrumentation (AAMI) and the Food and Drug Administration (FDA) issued a report based on a summit they convened in October suggesting that policy-makers were ignoring all the data coming from connected medical devices by focusing so much on EHRs.

?Healthcare organizations are focused on getting electronic health records (EHRs) up and running. Very few are stepping into the even more complex space of device interoperability,? the report said. But they eventually will need to pay attention to the latter, which includes everything from home health monitors to fitness counters to inpatient telemetry equipment.

?Getting it right protects patients, contributes to clinical decisions and positive patient outcomes, and improves efficiency. Getting it wrong introduces significant risk and the likelihood of adverse patient events. Worse, getting it wrong doesn?t mean returning to the baseline risks of an unconnected world ? it will lead to more serious situations than exist now. Safe interoperability is central, not peripheral, to the core mission of healthcare,? the AAMI and FDA said.

At least one person believes device interoperability is coming as soon as Stage 3, which is scheduled to start in 2016, or two years after a provider first achieves Stage 2, whichever is later. That person is Chuck Parker, executive director of the Continua Health Alliance.

Writing on the HIMSS blog this week, Parker said the current recommendations for Stage 3 promise to get everyone connected by encouraging patient engagement. ?If [the HIT Policy Committee's] recommendations come to pass, Stage 3 will encourage medical practices and hospitals to enlist their patients to use health devices and apps, and to accept patient-generated data into EHRs,? Parker said.

?Studies of connected health show that when patients incorporate mHealth?into their lives ? at home, work, and on the go ? they recognize the relationship between their health behaviors and experience of health and are consequently?better able to self-manage. My prediction is that practices and hospitals embracing Stage 3 will discover a new capacity to bring about positive outcomes through timely, targeted interventions, both at the individual and population levels,? Parker continued, but then he added one caveat: devices and IT systems need to be connected.

?The fact is, unless personal health devices work together with minimal effort, patients are unlikely to stick with mHealth tools, and the momentous opportunity for connected health will be lost,? Parker said.

Yes, interoperability remains elusive and difficult. But we have to get it right. Billions of public and private dollars are on the line here, and more importantly, so are millions of lives.

Tumor cells engineer acidity to drive cell invasion

Jan. 25, 2013 ? Researchers at Moffitt Cancer Center and colleagues at Wayne State University School of Medicine investigated the acidity in solid tumors to determine if pH levels play a role in cancer cell invasion in surrounding tissues. They found that an acidic microenvironment can drive cancer cells to spread and propose that neutralizing pH would inhibit further invasion, providing a therapeutic opportunity to slow the progression of cancers.

Their study appeared in the Jan. 3 online release of Cancer Research, a publication of the American Association for Cancer Research.

According to the study's corresponding author, Robert J. Gillies, Ph.D., chair of the Department of Cancer Imaging & Metabolism at Moffitt, acidity in solid tumors is the result of an increased fermentative metabolism combined with poor delivery of blood to tissues.

In this study, tumor invasion and pH were monitored in immunodeficient laboratory mice hosting a variety of tumors. "We monitored the test animals over time using microscopy and found that the highest regions of tumor invasion corresponded to areas with the lowest pH," Gillies explained. "Tumor invasion did not occur in regions with normal or near normal pH levels. Furthermore, when we neutralized the acidity with oral sodium bicarbonate, the invasion was halted."

Researchers proposed that the acidic pH of the tumor microenvironment represents a "niche engineering" strategy on the part of tumor cells, promoting invasion and growth of malignant tumors into surrounding tissue. Niche engineering is a concept in ecology describes how plants and animals alter their environment to in ways that promote their own growth and survival over their competitors. "We have long regarded cancers cells as an invading species," said study co-author Robert Gatenby, M.D., chair of the Diagnostic Imaging Services and Integrated Mathematical Oncology departments at Moffitt.

A key to this process of adaptation and invasion is increased glucose metabolism in the tumor. "The vast majority of malignant tumors metabolize glucose at high rates," Gillies said. "We have proposed that there is a direct, causative link between increased glucose metabolism and the ability of cancer cells to invade and metastasize."

According to the research, elevated glucose metabolism is the cause of increased acidity in the tumor microenvironment. Most tumors develop an abnormal vascular network that tends to be poorly organized and leaky, disrupting blood flow and hampering the delivery of oxygen.

"This poorly organized vascular system has a two-fold effect on tumor acidity," explained Gatenby. "First, it subjects tumor regions to poor perfusion, which restricts oxygen and increases the rate of glucose fermentation. Second, the poor perfusion hampers the ability to eliminate the resulting acids, resulting in very low pH in surrounding tissues."

As tumor cells adapt to increasing acidity, niche engineering through normal cell death and new blood vessel formation occurs in the tumor and the immune response is suppressed.

"Tumor cells perform niche engineering by creating an acidic environment that is not toxic to the malignant cells but, through its negative effects on normal cells and tissues, promotes local invasion of malignant cells," Gatenby said.

The researchers suggested that targeting this activity with buffers and other mechanisms aimed at increasing pH levels will likely provide a valuable alternative to traditional therapies focused entirely on killing tumor cells.

The civic body is all set to procure new technology and overhaul its hardware in a bid to improve interaction between citizens and the corporation.

The implementation of the Holistic and Integrated Greater Hyderabad Ego?vernance Solution (HI?GH eGOV) will be a reality by the beginning of the next financial year.

As part of the National Mission Mode Project (NMMP) for e-Governance in muni?cipa?lities the nodal agency AP Technology Services (APTS) is in the final stages of bidding with private companies. According to officials, the tender process is on and financial bidding is going on.

?It will provide the corporation with completely new technology, incl?u?ding an overhaul of existing hardware. If everything goes smoothly, it will be functional within the next three months,? said Ashok Reddy, additional commiss?ioner (Finance).

The significance of the project lies in improving interaction between citizens and the GH?MC when it comes to providing basic services for millions. It aims at providing more ?efficient?, ?conve?nient? and ?transparent? services to citizens and businesses.

According to officials, in order to automate departm?ental procedures and to leverage adv?an?cements in IT for effective administration, the GHMC has taken up several initiatives to computerise its business processes for imp?roving the efficiency in administration and service delivery.

The GHMC claims that this project will strengthen gov?ernance and broaden public participation by leveraging the ICT (Information Commu?ni?ca?tion Technology) for sustained improvement in service delivery. The process of system inte?grator for design development and maintenance of software, hardware and network is being taken care of by APTS.

For the development of the project the GHMC will be footing 50 per cent cost, 25 per cent by the State government and the remaining 25 per cent by the Central government respectively.

By facilitating the corporation to network with all zones and circles, the GHMC aims at bringing the services of the government closer to the door steps of the citizens through ?One click Interaction?.

LOS ANGELES, Jan 23 (Reuters) - The family of former San Diego Chargers star Junior Seau, who killed himself last year, sued the National Football League on Wednesday, saying that brain damage he suffered during his 20 years in the league led to his suicide.

Seau's children and ex-wife, along with the trustee of his estate, also claim in the San Diego Superior Court lawsuit that the NFL has long concealed from its players and the public the risks of neurological injury in the sport.

"We know this lawsuit will not bring back Junior," the Seau family said in a statement. "But it will send a message that the NFL needs to care for its former players, acknowledge its decades of deception on the issue of head injuries and player safety, and make the game safer for future generations."

An NFL spokesman, Greg Aiello, told Reuters in an email that the league's attorneys would review the lawsuit and respond to the claims appropriately in court.

Seau, a 12-time Pro Bowl linebacker for the Chargers and two other NFL teams during his two-decade career, died last May after shooting himself in the chest at his beachfront home in Oceanside, California.

The lawsuit filed by his family, which claims fraud, negligence and wrongful death, seeks unspecified damages from the league and several football helmet makers.

It comes seven months after some 2,000 ex-NFL players sued the league in federal court in Philadelphia over similar allegations, consolidating more than 80 lawsuits.

A study by independent researchers found that Seau, 43, suffered from chronic traumatic encephalopathy, or CTE - the same debilitating brain disease diagnosed in at least two other former NFL players who committed suicide.

The NFL has said the findings about Seau's brain underscored "the recognized need for additional research to accelerate a fuller understanding of CTE." League teams have donated $30 million to the National Institutes of Health for research.

PLAYER SAFETY VERSUS SPECTACLE

Concerns over the risk of brain injury from repeated concussions suffered by players in the NFL are growing. Football is America's most popular television sport and a $9 billion a year industry.

The league has attempted to institute rule changes protecting player safety while still preserving the spectacle fans enjoy, which is partly based on the speed and power of colliding athletes.

The Seau family says in their lawsuit that the NFL has long known that head trauma suffered by professional football players carried the risk of brain injury, while at the same time marketing the ferocity and brutality of the game.

"Instead of being honest about the dangers and working with both players and the medical community to minimize them, the league repeatedly asserted that professional football players were at no greater risk of brain or neurological injury than the public at large," the family says.

The complaint also details in grim terms Seau's battle with what the family believes were symptoms of CTE, including dizziness, depression, anxiety and insomnia.

"His increasing emotional instability resulted in uncharacteristically self-destructive, aggressive and violent behavior," the lawsuit says, adding that he became a compulsive, manic gambler and lost significant amounts of money.

Seau shot himself just weeks after former Atlanta Falcons safety Ray Easterling committed suicide at age 62. Easterling's family described a long descent into dementia following his retirement from the NFL, and an autopsy revealed indications of CTE.

In February 2011, four-time Pro Bowl safety Dave Duerson, who played most of his career with the Chicago Bears, shot himself in the chest. In a suicide note, he donated his brain for study, and it was found to exhibit signs of CTE.

CTE, once known as boxer's dementia, is caused by repeated impacts to the brain, and has been found in athletes who suffered head injuries as well as in members of the armed forces with concussive injuries from blast waves.

Because the mild and moderate brain injuries do not show up on CT scans or other imaging, the condition can be definitively diagnosed only through an autopsy. (Reporting by Dan Whitcomb; Editing by Cynthia Johnston, Claudia Parsons and Prudence Crowther)
